Penny Skips Skip Tracing Terms of Service

Please read these Terms of Service (“TOS”) carefully before using the Penny Skips website (“Website”) and our skip tracing services (“Services”). These TOS constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Penny Skips (“we,” “us,” or “our”).

1. Acceptance of Terms

By creating an account, subscribing to any plan, or using our Website and Services, you agree to comply with and be bound by these TOS. If you do not agree to these terms, do not use our Website or Services. Your continued use of the Services following any updates to these TOS constitutes acceptance of those changes.

2. Skip Tracing Services

Penny Skips provides skip tracing data services, helping users locate contact information for individuals. Our Services are delivered digitally through our online platform. Services are subject to the fees and subscription terms specified on the Website at the time of purchase. Data is delivered electronically upon processing and is considered received at the time it is made available in your account.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at i[email protected] of any unauthorized use of your account.

4. Subscription Plans and Billing

4.1 Recurring Billing. By subscribing to a Penny Skips plan, you authorize us to charge your payment method on a recurring basis (monthly or as specified at the time of purchase) at the then-current subscription rate. Charges will automatically renew on each billing cycle until you cancel your subscription in accordance with Section 5 of these TOS.

4.2 Payment Authorization. You represent and warrant that you are authorized to use the payment method you provide and that the information you supply is accurate and complete. You authorize Penny Skips to charge your payment method for all fees incurred in connection with your account.

4.3 Price Changes. We reserve the right to change subscription pricing at any time. If we change the price of your subscription, we will notify you by email at least 14 days before the change takes effect. Your continued use of the Services after a price change constitutes acceptance of the new price.

4.4 Failed Payments. If a payment fails, we may retry the charge and/or suspend your access to the Services until payment is successfully processed. You are responsible for ensuring your payment method remains valid and has sufficient funds.

5. Cancellation and Refund Policy

5.1 How to Cancel. You may cancel your subscription at any time by emailing [email protected] or by using the cancellation option in your account dashboard. Cancellation requests must be submitted at least five (5) business days before your next billing date to avoid being charged for the next billing cycle.

5.2 Effect of Cancellation. Upon cancellation, your subscription will remain active through the end of your current paid billing period. You will not be charged for any subsequent billing periods. No partial or prorated refunds will be issued for unused time remaining in your current billing cycle.

5.3 Refund Policy. Because skip tracing data is delivered digitally and immediately upon processing, all sales are final. Refunds are generally not available once data has been delivered or made accessible in your account. In limited circumstances, refunds may be considered at our sole discretion if you contact us within 48 hours of a charge and have not accessed or downloaded any data during that billing period.

5.4 Chargebacks and Disputes. You agree to contact Penny Skips directly at [email protected] to resolve any billing issues or concerns before initiating a chargeback or dispute with your bank or payment provider. Filing a chargeback or payment dispute without first attempting to resolve the issue directly with Penny Skips may result in the permanent suspension of your account. We reserve the right to dispute any chargeback and provide evidence to your payment provider and card network.

6. Service Delivery and Data Access

Skip tracing results are delivered digitally through your account on our platform. Data is considered delivered and the service is considered rendered at the time the results are made available in your account, whether or not you choose to view, download, or use the results. Logging into your account or submitting data for processing constitutes use of the Services for that billing period.

7. Privacy Policy

Your use of the Website and Services is also governed by our Privacy Policy, which can be found at https://pennyskips.com/privacy-policy. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

8. User Conduct

You agree to use our Services in compliance with all applicable federal, state, and local laws, regulations, and these TOS. You agree not to use data obtained through our Services for any unlawful purpose, including but not limited to harassment, stalking, or any activity that violates the Fair Credit Reporting Act (FCRA) or similar regulations. You acknowledge that Penny Skips is not a consumer reporting agency and our Services do not constitute consumer reports under the FCRA.

9. Intellectual Property

All content, design, and materials on the Website are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

10. Termination

We reserve the right to terminate or suspend your access to the Website and Services at our sole discretion, with or without notice, for any reason, including but not limited to violation of these TOS, fraudulent activity, or abuse of our dispute resolution process.

11. Dispute Resolution

11.1 Contact Us First. If you have any dispute, claim, or concern relating to the Services, you agree to first contact us at [email protected] and make a good-faith effort to resolve the dispute informally for at least thirty (30) days before pursuing any formal action, filing a chargeback, or initiating a dispute with your bank or payment provider.

11.2 Governing Law. These TOS are governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under these TOS shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.

12. Disclaimer of Warranties

While we make every effort to provide accurate information, we do not guarantee the accuracy, completeness, or reliability of the data obtained through our Services. Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Penny Skips shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these TOS or your use of the Services shall not exceed the amount you paid to Penny Skips in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Penny Skips and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of our Services, your violation of these TOS, or your violation of any applicable law or regulation.

15. Changes to Terms of Service

We may update or modify these TOS at any time. Material changes will be communicated by posting the revised TOS on our Website with an updated effective date. Your continued use of the Website and Services following the posting of changes constitutes acceptance of those changes.
