Penny Skips Skip Tracing Terms of Service

Please read these Terms of Service (“TOS”) carefully before using the Penny Skips website (“Website”) and our skip tracing services (“Services”). These TOS constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Penny Skips (“we,” “us,” or “our”).

1. Acceptance of Terms

By creating an account, placing an order, or using our Website and Services, you agree to comply with and be bound by these TOS. If you do not agree to these terms, do not use our Website or Services. Your continued use of the Services following any updates to these TOS constitutes acceptance of those changes.

2. Skip Tracing Services

Penny Skips provides skip tracing data services, helping users locate contact information for individuals. Our Services are delivered digitally through our online platform. Services are subject to the fees and order terms disclosed at the time of purchase. Data is delivered electronically upon processing and is considered received at the time it is made available in your account.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at i[email protected] of any unauthorized use of your account.

4. Wallet Deposits and Pay-As-You-Go Billing

4.1 Wallet Deposits. Skip tracing is offered on a pay-as-you-go basis. Add a minimum of $10 to your Penny Skips account before running orders. Deposits purchase prepaid account credit. Unused account credit does not expire.

4.2 Payment Authorization. You represent and warrant that you are authorized to use the payment method you provide and that the information you supply is accurate and complete. You authorize Penny Skips to charge your payment method for all fees incurred in connection with your account.

4.3 Pricing. Phone matches cost $0.02 per matched record. A billable phone match is a returned phone number believed to belong to the person and address submitted for skip tracing. Optional email matching costs an additional $0.01 per record for which an active email address is found. No phone match means no phone-match charge; no active email match means no email-match charge. Prices for future orders may change and will be disclosed before you submit an order.

4.4 Failed Payments. If a payment fails, we may retry the charge and/or suspend your access to the Services until payment is successfully processed. You are responsible for ensuring your payment method remains valid and has sufficient funds.

5. Orders and Refund Policy

5.1 Ordering. You choose when to add wallet credit and submit skip tracing orders. Review the order details, selected services, and displayed charges before submitting an order.

5.2 Account Credit and Results. Unused wallet credit does not expire. Your saved lists and results remain available in your account without a list-expiration date.

5.3 Refund Policy. Because skip tracing data is delivered digitally upon processing, completed data purchases are generally final once the results have been delivered or made accessible in your account. In limited circumstances, refunds may be considered at our discretion if you contact us within 48 hours of an order charge and have not accessed or downloaded that order’s data. This policy does not limit any rights or remedies required by applicable law.

5.4 Chargebacks and Disputes. You agree to contact Penny Skips directly at [email protected] to resolve any billing issues or concerns before initiating a chargeback or dispute with your bank or payment provider. Filing a chargeback or payment dispute without first attempting to resolve the issue directly with Penny Skips may result in the permanent suspension of your account. We reserve the right to dispute any chargeback and provide evidence to your payment provider and card network.

6. Service Delivery and Data Access

Skip tracing results are delivered digitally through your account on our platform. Data is considered delivered and the service is considered rendered at the time the results are made available in your account, whether or not you choose to view, download, or use the results.

7. Privacy Policy

Your use of the Website and Services is also governed by our Privacy Policy, which can be found at https://pennyskips.com/privacy-policy. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

8. User Conduct

You agree to use our Services in compliance with all applicable federal, state, and local laws, regulations, and these TOS. You agree not to use data obtained through our Services for any unlawful purpose, including but not limited to harassment, stalking, or any activity that violates the Fair Credit Reporting Act (FCRA) or similar regulations. You acknowledge that Penny Skips is not a consumer reporting agency and our Services do not constitute consumer reports under the FCRA.

9. Intellectual Property

All content, design, and materials on the Website are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.

10. Termination

We reserve the right to terminate or suspend your access to the Website and Services at our sole discretion, with or without notice, for any reason, including but not limited to violation of these TOS, fraudulent activity, or abuse of our dispute resolution process.

11. Dispute Resolution

11.1 Contact Us First. If you have any dispute, claim, or concern relating to the Services, you agree to first contact us at [email protected] and make a good-faith effort to resolve the dispute informally for at least thirty (30) days before pursuing any formal action, filing a chargeback, or initiating a dispute with your bank or payment provider.

11.2 Governing Law. These TOS are governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under these TOS shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.

12. Disclaimer of Warranties

While we make every effort to provide accurate information, we do not guarantee the accuracy, completeness, or reliability of the data obtained through our Services. Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, Penny Skips shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these TOS or your use of the Services shall not exceed the amount you paid to Penny Skips in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Penny Skips and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of our Services, your violation of these TOS, or your violation of any applicable law or regulation.

15. Changes to Terms of Service

We may update or modify these TOS at any time. Material changes will be communicated by posting the revised TOS on our Website with an updated effective date. Your continued use of the Website and Services following the posting of changes constitutes acceptance of those changes.
